Terms and Conditions

1. Purpose
The purpose of these Terms and Conditions is to define the terms and conditions of sale, access and use of search engine results databases (hereinafter the “Databases”) offered via the Semdatabase platform (hereinafter “the Platform”), operated by Monitorank SAS, 950 route des Colles, 06410 BIOT, 820 739 241 R.C.S. Grasse.
2. Nature of the products
The Databases sold on the Platform are sets of raw or enriched data, compiled from search engine results (SERPs) collected on specific dates and for specific keywords. Each Database contains information such as ranked URLs, positions, titles, snippets, or other publicly available metadata.
3. Ordering and access
The purchase of a Database entitles the purchaser to:
- full and permanent access to the purchased Database,
- a download in CSV, JSON format,
- a non-exclusive and non-transferable license under the terms and conditions set out in Article 4.
Payment is made online using the methods offered on the Platform. Once payment has been confirmed, the Database can be downloaded immediately.
4. License to use
The purchaser obtains a license allowing them to:
- use the Database internally for their own needs (analysis, monitoring, reporting, R&D);
- use the Database in an SEO tool, whether public or private, which they publish themselves;
- publish statistics or analyses derived from the Database, provided that the Database itself is not redistributed and its content is not disclosed in its entirety.
It is strictly prohibited to:
- resell, redistribute, or make available, free of charge or for a fee, all or part of the Database to third parties, in any form whatsoever.
- integrate the Database into a product or service whose purpose is the resale of raw SERP data;
- provide an API or interface allowing automated or mass access to the Database without the prior written consent of Monitorank SAS.
5. Intellectual property
All Databases offered are the property of Monitorank SAS, with regard to the effort involved in structuring, organizing, and enriching them. The data itself, which comes from search engines, is public, but its formatting, grouping, and provision in the form of a Database are protected.
No transfer of intellectual property rights is made to the purchaser. The purchaser only obtains a license to use the data under the conditions defined above.
6. Liability
The publisher cannot be held liable for the consequences of:
- the use of data for illegal purposes or purposes contrary to the T&Cs;
- any changes in search engine policies affecting the legality or feasibility of certain uses.
The publisher strives to ensure the accuracy of the data at the time of collection, but does not guarantee its completeness or real-time updating.
7. Right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content provided on an intangible medium and whose performance has begun after the buyer's prior express agreement.
By confirming their order, the buyer expressly waives their right of withdrawal.
8. Modifications
The publisher reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in force at the time of purchase.
9. Applicable law – Competent jurisdiction
These T&Cs are governed by French law. Any dispute relating to their interpretation or execution shall be submitted to the competent courts of Antibes.
